Hello!

In the UK, “next of kin” (parenti prossimi) refers to the closest (più stretti) living blood relatives (consanguinei) of a deceased person. This term is crucial in matters of succession, particularly when someone dies without a will (testamento) —known as intestacy.

When a person passes away (muore) intestate, UK law dictates (stabilisce) that their estate (asse ereditario) – property, assets, and possessions – should be distributed to their next of kin according to a legal hierarchy (gerarchia).

Under UK intestacy laws, the distribution of the deceased’s estate follows a set order (ordine prestabilito). The spouse or civil partner has the first claim, and if there are no children, they may inherit the entire estate. If the deceased has children, the spouse or civil partner may receive a portion of the estate, and the remainder is divided among the children.

If the deceased has no spouse or children, the estate may pass to other close relatives in this order: parents (genitori), siblings (fratelli e sorelle), nieces (le nipoti) and nephews (i nipoti), grandparents (nonni), and then uncles (zii) and aunts (zie). Importantly, relatives-in-law (parenti acquisiti) – those related by marriage, such as a spouse’s parents or siblings (fratelli e/o sorelle) – do not inherit under intestacy law, as they are not considered blood relatives. If no blood relatives are found, the estate becomes “bona vacantia”, meaning it passes to the Crown.

Remember however that next of kin does not automatically mean a person has legal rights over an estate-only the intestacy rules determine who inherits in the absence of a will.
