What exactly is probate?
Probate is the legal process of dealing with someone’s estate (asse ereditario) after they have died. This includes identifying the assets and liabilities of the estate, paying any debts, and distributing the remaining assets (beni rimanenti) to the beneficiaries as set out in the will or according to the law.
When you get probate you automatically become the legal owner of the all the assets as a trustee for the beneficiaries of the estate.
The first step in applying for (richiedere) probate is to find out if it is needed. Probate is not always required. For example, if the total value of the estate is below a certain threshold (soglia), you may not need to apply for probate. Every bank and financial institution has their own rules on how much money they can release before seeing a grant (concessione) of probate and this may vary (variare) between £5,000 and £50,000.
If probate is required, then you will need to determine if you are eligible (idonei) to apply. To be eligible, you must be the executor of the will or a beneficiary named in the will.
Once you have established that probate is required and that you are eligible to apply, you will need to value the estate. This involves identifying all of the assets and liabilities (attività e le passività) of the estate and working out (calcolandone) their value.
You will also need to find out if Inheritance Tax needs to be paid. Once you have valued the estate and determined whether Inheritance Tax needs to be paid, you can then apply for probate. You can apply online or by post.
Once probate has been granted, you will be the legal personal representative of the estate and you will be able to deal with the assets and liabilities of the estate.
